A. Consider introduction of Ordinance 501, waiving first reading, amending the Municipal Code by repealing Chapter 6.20 concerning commercial kennels; adding Section 17.02.615 to define "Pet Care Services;" amending Section 17.02.745 concerning "Storage;" adding Section 17.02.766 to define "Transit/Transportation Facilities;" adding Section 17.02.768 to define "Trucking and Transport Uses;" amending Section 17.02.790 concerning "Warehousing;" repealing Section 17.02.800 concerning "Wholesale;" amending Section 17.04.010 concerning establishment of districts; repealing Chapter 17.20 concerning the Manufacturing District and adopting a new Chapter 17.20 concerning the Southeast Bayshore Trade Commercial District; adding Chapter 17.21 concerning the Northeast Bayshore Trade Commercial District; and amending the Zoning Map (Continued from May 16, 2005)

* This item will include a presentation by Gary Morrow on federal and state regulations and protocols regarding the use of laboratory animals

(The M-1 District regulations are proposed to be updated, consistent with the General Plan’s Trade Commercial land use designation for the Southeast Bayshore an Northeast Bayshore subareas.)

B. Consider adoption of Ordinance No. 502, waiving second reading, an Ordinance of the City of Brisbane amending the Zoning Ordinance by adding Section 17.02.598 to define "Organics Reload Operations"; amending Section 17.15.030 concerning Conditional Uses; and amending Section 17.15.040 concerning Development Regulations

(The proposed ordinance would allow SF Recycling & Disposal, Inc., to relocate its current organic waste transfer operations from the San Francisco side of the border to the Brisbane side within the existing transfer station building that straddles the city limit line, so the reloading activity could be segregated from the operations involving other solid waste materials currently transferred at the facility. The former location will revert to its previous solid waste management activities. The proposal will not increase the permitted capacity of transferred organics.)

* C. Consider appeal of the Planning Commission’s Conditional Approval of Use Permit Application UP-1-02 and Design Permit Application DP-1-02 for 30 Residential-Unit Complex on Unrecorded Highway Lots 7-12; Charles and Judy Ng, applicants and owners; APN 007-350-040 through -090  (No Staff Report - Staff recommends continuance to July 18, 2005)

(The Planning Commission reviewed and approved the above listed 30-Residential Unit Complex subject to certain conditions. Two members of the City Council appealed that decision and the full Council will review the approval and conditions.)

* D. National Pollutant Discharge Elimination System Stormwater Program Fees. Hold Public Hearing, Receive Public Comment, and Consider Adopting the following Resolutions Imposing Charges for Funding the Local Brisbane and Countywide General Stormwater Programs

1. Resolution No. 2005-28 "A Resolution of the City Council of the City of Brisbane Imposing Charges for Funding the Local Brisbane Stormwater Program, Authorizing Placement of Said Charges on the 2005-2006 County Tax Roll, and Authorizing the County Tax Collector to Collect Such Charges."

2. Resolution No. 2005-29 "A Resolution of the City Council of the City of Brisbane Recommending the San Mateo County Flood Control District Impose Basic and Additional Charges for Funding the 2005/2006 Countywide National Pollutant Discharge Elimination System (NPDES) Stormwater General Program Scope of Work, Authorizing Placement and Collection by the County Tax Collector of Said Basic Charges on the 2005-2006 County Tax Roll, and Authorizing Funding of Said Additional Charges Through the General Fund."

(The National Pollution Discharge Elimination System Program is a federally mandated program which requires local governments to control and reduce the amount of stormwater pollution runoff into receiving waters of the United States. Since 1998, fees to administer this program have been billed through the property tax bills sent by the County of San Mateo. The resolutions listed above adopt the yearly program, and authorized the placement of the charges on the County Tax Roll.)
