VI. CONSENT CALENDAR

A. Adopt City Council Minutes of February 1, 2010

B. Approve proposal and authorize the Mayor to execute a contract with CJ MacDonald of Aloft Consulting for design and implementation of a new City Website

C. Approve co-sponsorship of the Brisbane Library’s performance presenting Chanson du Soir, classical guitar and vocal duet, in the Mission Blue Center on March 26, 2010

VII. PUBLIC HEARING

A. Consider joining the CaliforniaFIRST program for the financing of water and energy efficiency and renewable energy retrofit projects

1. Adopt Resolution No. 2010-08 authorizing the City of Brisbane to join the CaliforniaFIRST program; authorizing the California Statewide communities Development Authority to accept applications from property owners, conduct contractual assessment proceedings and levy contractual assessments within the territory of the City; and authorizing related actions

2. Adopt Resolution No. 2010-09 authorizing the lead collaborative entity to apply for funds on behalf of the local governmental jurisdiction

3. Adopt Resolution No. 2010-10 approving, authorizing and directing execution of an amended and restated joint exercise of powers agreement relating to the California Statewide Communities Development Authority

(If the Sacramento County grant application is funded, these resolutions will, at no cost to the City, enable residential, commercial and industrial property owners in Brisbane to participate in a contractual assessment district that will finance water and energy efficiency and renewable energy retrofit projects. Repayment would occur by means of assessments on the benefitting owners’ property tax bills)

B. Consider adoption of Resolution No. 2010-11 authorizing the Association of Bay Area Governments to apply for State Energy Program (SEP) funds on behalf of the City of Brisbane

(This action will support a grant program which will fund the development of an energy conservation and renewable energy retrofit industry in the Bay Area)

VIII. OLD BUSINESS

A. Northeast Ridge Residential Development Compliance Hearing (Continued from February 1, 2010)

1. Consider adoption of Resolution No. 2010-01, making findings and granting final approval and certifying the 2009 Addendum to the San Bruno Mountain Habitat Conservation Plan 1982 Environmental Impact Report/Environmental Assessment, and the 2007 Addendum to the 1983 Final Environmental Impact Report on the Northeast Ridge Residential Development

2. Consider adoption of Resolution No. 2010-02, approving an amendment to the Habitat Conservation Plan (HCP) Agreement and granting final approval for a modification to the vesting tentative map (VTM-1-06), Planned Permit (EX-1-06), Design Permit (DP-3-06), and Grading Permit (EX-1-06) for Unit II, Neighborhood II, of the Northeast Ridge Residential Development (APN 005-020, 030, & 040).

(Approval of the modified project for the Northeast Ridge will result in: the elimination of 80 units that were approved for development in the 1989 Vesting Tentative Map (“1989 VTM”); the relocation of the remaining units to an area having little or no habitat value, thereby enabling the preservation of prime habitat as open space; and a significant and substantial increase in the funding being provide to the HCP by the developer and the future property owners.

Approval of HCP Amendment No. 5 would modify the HCP’s existing operating program for the Northeast Ridge Parcel, amend the funding provisions contained in the HCP, and add the Callippe Silverspot Butterfly and Bay Checkerspot Butterfly to the list of species covered by the incidental take permit for the HCP.)

IX. NEW BUSINESS

A. Update from Director of Public Works/City Engineer Breault on the “Statewide Local Streets & Roads Needs Assessment” study, the existing conditions and maintenance needs for Brisbane roads, and discuss various actions and proposals that may jeopardize local streets maintenance funding

(A presentation will be given on the importance of the maintenance of the existing streets and roadways and the various actions and proposals that may jeopardize funding.)
